  • Preparation

    We review the technical materials, applicant information, inventor information, priority documents, filing route, and available prior art information. 

    For foreign-originated applications, we also review the source application and coordinate Chinese-language preparation.

  • Filing Document Preparation

    We prepare or review the specification, claims, abstract, drawings, power of attorney, priority documents if any, assignment documents if required, and other filing materials.

  • Submit Filing

    We file the invention patent application with CNIPA. An official filing receipt is usually issued after submission.

  • Formality Examination

    CNIPA reviews whether the application documents meet formal filing requirements. Any formality defects may need to be corrected within the prescribed period.

  • Publication

    An invention patent application is normally published 18 months from the filing date or priority date, unless early publication is requested.

  • Substantive Examination

    A request for substantive examination must be filed within the statutory deadline. During substantive examination, CNIPA examines novelty, inventiveness, practical applicability, clarity, support, unity, and other patentability requirements.

  • Office Action Response

    If CNIPA issues an office action, we review the objections, analyze possible amendment and response strategies, and prepare a response within the applicable deadline.

  • Grant and Registration

    If the application is allowed, the applicant pays the required grant and annuity fees. CNIPA then issues the patent certificate.

  • Annuity and Maintenance

    After grant, annuity fees must be paid yearly to maintain the invention patent. A Chinese invention patent is generally protected for 20 years from the filing date, subject to annuity payments and applicable legal requirements.

  • ● What documents are usually required for a Chinese invention patent application?

    ◎ The required documents usually include the patent specification, claims, abstract, drawings if any, applicant and inventor information, a signed power of attorney, priority documents or DAS code if priority is claimed, and assignment documents if required.




  • ● Can a foreign applicant enter the PCT national phase in China?

    ◎ Yes. A foreign applicant may enter the PCT national phase in China through a qualified Chinese patent agency. The application must be filed in Chinese, and the required national phase documents must be prepared and submitted to CNIPA.




  • ● What is the deadline for PCT national phase entry in China?

    ◎ The standard deadline is 30 months from the earliest priority date. In some cases, a limited late-entry option may be available upon payment of additional official fees, subject to applicable CNIPA rules.
